ABSTRACT: This system contains correspondence/claim forms submitted by claimants, internal reports and related documents concerning the merits of the claim, adverse actions grievances, unfair labor practice charges, Equal Employment Opportunity and other employee claims, tort claims, copies of civil actions filed and criminal investigative records related to the civil action, witness statements, reports of interviews, exhibits, attorney notes, pleadings, recommendations and strategy related to various administrative and judicial proceedings.

PURPOSE: Records in this system aid in managing the caseload of administrative and judicial proceedings against the USMS and/or USMS personnel, and in defending civil actions or pursuing Federal court actions initiated by the USMS.

ACCESS CONSTRAINTS: Records are protected from unauthorized access through appropriate administrative, physical, and technical safeguards. These safeguards include restricting access to those with a need-to-know to perform their official duties and using locks and passwords.

USE CONSTRAINTS: Users are restricted to only those privileges necessary to perform assigned tasks.

AGENCY PROGRAMS: This system supports the USMS in investigating, recommending and determining appropriate action on claims against the USMS, in defending the USMS and/or USMS personnel in administrative and judicial proceedings, and in pursuing Federal court actions initiated by the USMS or the Department of Justice.

SOURCES OF DATA: Data contained in this system is provided by the individual claimant/litigant, USMS officials, law enforcement agencies, statements of witnesses and parties, transcripts of depositions and court proceedings, administrative hearings and arbitrations, and work product of staff attorneys and legal assistants working on a particular case or matter.
