MAJOR FUGITIVE ARRESTED
A major fugitive wanted by the United States Marshals has been arrested
in Detroit, Michigan.
Bobby Smith aka: Brumley Smith , age 42, was being sought for failing to
register as a sex offender under the Walsh Act. In July of 2006, President
Bush signed into law the Adam Walsh Child and Safety Act. This law made it a
federal offense for convicted sex offenders who have failed to register on
the sex offender list. The United States Marshals Service was designated as
the primary agency to enforce the act.
Smith was convicted of First Degree Rape and First Degree Sodomy in New York
in 1989 after an incident where Smith and others held two twenty year old
females at gun point and forced them to commit sex acts. Since his release
from prison in 2004, Smith has not registered or made any contact with New
York authorities even after numerous attempts to bring him into compliance
with registry laws. He left New York in 2004, moved to Detroit, and changed
his name to Brumley Smith. Smith also made no attempt to register in
Michigan.
In early 2006, New York authorities contacted the Michigan State Police
concerning Smith, and the MSP worked with the U.S. Marshals to locate him.
He was found under the Brumley Smith alias and was living at 1672 Fullerton
in Detroit, Michigan.
In the early afternoon of December 22nd, 2006, members of the U.S. Marshal
led Detroit Fugitive Apprehension Team (DFAT), which includes the Detroit
U.S. Marshals, Michigan State Police, Wayne County Sheriff’s Office,
Sterling Heights Police Department, and the Oakland County Sheriff’s Office,
went to the address and effectuated the arrest of Smith without incident.
Smith is facing up to ten years in prison.
United States Marshal Robert M. Grubbs commented that the “Walsh Act has
become a very important tool in helping the Marshal Service take dangerous
sex offenders off the street when they fail to comply with the law.” Our
agency “looks forward to many years of working closely with the Michigan
State Police and other local agencies in eradicating any threat posed by
these predatory members of society.”
Annually, investigations carried out by the U.S. Marshals result in the
apprehension of approximately 34,000 federal fugitives. More federal
fugitives are arrested by U. S. Marshals than all other federal agencies
combined.
