Lot Sale of Lakeside Marina, LLC Assets

The United States Marshals Service (USMS) has received an unsolicited offer of $28,000 cash to purchase an asset lot of Lakeside Marina, LLC, to include: (i) a 10x20’ finished glass building structure; (ii) a children’s playground equipment set; (iii) an unfinished deck project; (iv) approximately 100 railroad ties; (v) four (4) 1,000 gallon concrete septic holding tanks, partially buried; and (vi) a 28x32’ unfinished bath house block building with five (5) steel beams. All assets are being sold in one lot “as is, where is” with no warranties or representations whatsoever. The assets are currently located in Morgantown, West Virginia. All assets can be viewed on April 5, 2013 by appointment only, please contact Kim Landes at (304) 622-5330. All parties interested in viewing the assets must come with a signed hold harmless agreement.

Any persons interested in submitting a competing bid for the entire asset lot must submit a written offer by April 10, 2013. The assets will be sold in one lot only, and the USMS will not accept any offers that do not include the entire asset parcel lot. The USMS will not accept any offers that do not provide for a basis to remove all assets from their current location at purchaser’s sole cost on or before April 30, 2013.

A qualifying competing offer must be no less than five percent (5%) above the unsolicited offer price of $28,000. Upon receipt of any competing offers, the USMS will notify the original offeror of the competing offer(s) but will not disclose the amount(s) of the competing offer(s). The USMS will then allow the original offeror to increase his offer by submitting a best and final. The property will be sold to the highest acceptable offeror. The terms of any competing offer are subject to acceptance by the USMS. All offers must be accompanied by a cashier’s check for 100% of the offer price as a deposit. Deposits will be refunded from offers not accepted. Once an offer is accepted, failure to complete the purchase for any reason will result in forfeiture of the deposit.
